Overview

The Superior Court Rules Committee reviews and updates the rules that guide how court cases are handled in Superior Court. The committee makes sure rules are fair, clear, and up to date.

How the Rulemaking Process Works

Step 1. Advisory Committee Review

An advisory committee looks at any proposed changes to court rules. These ideas may come from the public or from committee members. There are different advisory committees, like the Civil Rules Advisory Committee and the Criminal Rules Advisory Committee, that focus on civil or criminal rules. The advisory committees also review yearly updates or changes to the Federal Rules of Civil and Criminal Procedure to determine how they may impact our rules.

Step 2. Superior Court Rules Committee Review

If an advisory committee agrees with a proposed change (or a version of it), the proposal is sent to the Superior Court Rules Committee for review. If the change is about a federal rule, the advisory committee also lets the Rules Committee know if it wants to follow the federal amendment.

Step 3. Public Notice and Comment

If the Rules Committee approves a proposed rule change, it is published for public comment. This happens in the Daily Washington Law Reporter and on the DC Courts’ website. The DC Bar and other groups also get the notice.

Step 4: Public Comments and Recommendations

The committee reviews any comments from the public. Then, it decides whether to recommend the rule change to the Superior Court Board of Judges.

Step 5. Review by the Board of Judges

The Board of Judges looks at the recommendation and decides whether to approve the rule change.

Step 6: Final Approval

If the rule change is related to federal rules, it must go to the District of Columbia Court of Appeals (DCCA) for approval.

  • If approved, the Chief Judge of the Superior Court can make the new rule official (this is called “promulgation”).
  • If the rule isn’t related to federal rules, the Chief Judge can approve it right away.

About the Rules Committee

The Rules Committee is made up of judges from different parts of the Superior Court. These judges are appointed by the Chief Judge.

The committee works with advisory committees that focus on specific types of rules, such as criminal, probate, or civil rules. These advisory committees include:

  • Judges
  • Lawyers who work in that area of law
  • Court staff
  • An attorney from the DC Courts’ Office of General Counsel

They all help the committee understand both legal and practical issues related to the rules.

How to Suggest Changes or Comment on Rules

The court wants the public to help improve the rules. You can:

  • Suggest a rule change
  • Comment on a rule that is under review
