NOTICE

Pursuant to D.C. Code § 11-2601 et seq, the Plan for Furnishing Representation to Indigents Under the District of Columbia Criminal Justice Act, Title II § B(2) and Miscellaneous Order No. M-216-03, the Court of Appeals is undertaking to reconstitute its list of attorneys available for appointment under the Criminal Justice Act (CJA) to represent indigent defendants and respondents on appeal in criminal and juvenile delinquency cases and in cases in which defendants and respondents are exposed to incarceration. A copy of Miscellaneous Order No. M-216-03 is appended hereto. This undertaking follows an extended review by the court of the current CJA plan and consultations with an attorney advisory committee including representatives of the District of Columbia Association of Criminal Defense Lawyers, the Superior Court Trial Lawyers Association, the District of Columbia Public Defender Service, and the Office of Bar Counsel.

All attorneys who are interested in being considered for inclusion in the reconstituted list, including attorneys who are on the current list and attorneys who seek appointment only in appeals in which they were counsel of record in the trial court, must submit a completed application within 45 days from the date of this notice. Once the application process is completed, the applications reviewed, and a new CJA list constituted, all appointments will be made solely from this list, except in special circumstances and as decided by the court. The application process will be reopened annually, or more frequently if necessary.

An application for inclusion on the CJA appellate list may be obtained from the Court of Appeals section of the D.C. Bar's website (www.dcca.state.dc.us) or from the Clerk's
Office located on the Sixth Floor of 500 Indiana Avenue, N.W., Washington, D.C. 20001.

Applications must be received and date stamped by the Clerk's Office no later than 45 days from the date of this notice. Applicants should read Miscellaneous Order No. M-217-03, appended hereto, which establishes a Continuing Legal Education requirement for attorneys on the new CJA list, and the memorandum issued by the court together with the application entitled "Obligations of Counsel." Submission of an application constitutes an applicant's commitment to fulfill the obligations set forth in the aforementioned order and memorandum if the application is approved.
